ShopReply provides automated missed-call text-back, after-hours SMS response, and lead capture services for auto repair shops and similar local businesses. We act as a communication layer between businesses and their customers.
2. Eligibility
You must be at least 18 years of age to use our services. By using ShopReply, you represent that you meet this requirement.
3. Use of Services
You agree to:
- Provide accurate information when interacting with our systems.
- Not use our services for any unlawful or unauthorized purpose.
- Not attempt to interfere with, compromise, or disrupt our services.
- Not send spam, abusive, or fraudulent messages through our platform.
4. SMS Communications
By initiating contact with a business using ShopReply, you consent to receiving automated SMS responses related to your inquiry. You may opt out at any time by replying STOP. Standard message and data rates may apply.
5. Business Client Terms
If you are a business subscribing to ShopReply services:
- You are responsible for ensuring your use of our services complies with all applicable laws, including the Telephone Consumer Protection Act (TCPA) and any state-level regulations.
- Subscription fees are billed monthly. The one-time setup fee is non-refundable after onboarding has begun.
- You may cancel your subscription at any time. Service will continue through the end of the current billing period.
6. Intellectual Property
All content, design, and technology on the ShopReply website and platform are owned by ShopReply and protected by applicable intellectual property laws. You may not copy, modify, or distribute our materials without written permission.
7. Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our services will be uninterrupted, error-free, or completely secure.
8. Limitation of Liability
To the fullest extent permitted by law, ShopReply shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to lost revenue, missed business opportunities, or data loss.
9. Indemnification
You agree to indemnify and hold harmless ShopReply and its officers, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these Terms.
10. Changes to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised date. Continued use of our services after changes constitutes acceptance of the new Terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
